Terms of Use World of WOW - Creators

Hi! Welcome to the World of WOW platform (hereinafter referred to as the Platform) of World of WoW Holding B.V., a company based in (5617 BC) Eindhoven at the Torenallee 20, registered with the Dutch Chamber of Commerce under number 92209688, with VAT number NL865934940B01 (hereinafter referred to as World of WOW, we, our or us). The use of the Platform is free of charge and is provided to you as a creator (you or your) by World of WOW.

General

‍These Terms of Use (the Terms) govern your use of the Platform. By installing and/or using the Platform, you agree to be bound by these Terms.
You may download and save these Terms.

Article 1 – Right to use the Platform

‍1.1 Upon accepting these Terms, you obtain a personal, revocable, non-exclusive, non-sublicensable, and non-transferable right of use (license) to use the Platform and all its encompassed content and features for your personal use, subject to the restrictions and provisions outlined in these Terms.
1.2 If this license is terminated – for any reason at all – you must stop using the Platform.

Article 2 – Account and personal dashboard

‍2.1 Upon successful registration, you will be able to create a personal account on the platform.
2.2 When creating an account, you warrant that the information provided to us is accurate. We ask that you notify us of any changes to your details.
2.3 You will have access to a personal dashboard through your account. The dashboard will provide you with an overview of your activities, user statistics, overview of your social media platforms linked to the Platform, settings and other account-related information on the Platform.
2.4 We expect you to maintain the confidentiality of your username associated with your personal account and inform us immediately in the event of a security breach or unauthorized use of your account.

Article 3 – Use of the Platform

‍3.1 We provide the Platform with the utmost care. However, the effectiveness of the Platform and the quality of the information are also contingent on your device, such as a smartphone or tablet (Device), the software and operating system utilized on the Device, and your internet connection.
3.2 To use the Platform, you must have a Device with an (internet) connection. The associated costs are at your own expense.
3.3 You may not modify, copy, decompile, damage, overburden, interfere with, or interfere with the use and functioning of the Platform.
3.4 We reserve the right to modify the Platform, alter and/or delete data, restrict the Platform's use, or deny your access to the Platform, in whole or in part, temporarily or permanently at any time (for instance, if you violate these Terms, or if your use of the Platform infringes upon the rights of World of WOW or third parties).
3.5 You cannot derive any rights from the information contained in the Platform.
3.6 By installing and using the Platform, you acknowledge and understand the following:
– 3.6.1 Installation and use of the Platform are entirely at your own expense and risk;
– 3.6.2 You are solely responsible for all content, including but not limited to any collaborations with brands, music and videos, that you upload, post, email, transmit, or otherwise disseminate using, or in connection with, the Platform (User Content);
– 3.6.3 You will not use the Platform to upload, embed, post, email, transmit, or otherwise disseminate any content that infringes on the rights of third parties, including, but not limited to, any intellectual property rights, rights of privacy, or rights of publicity. This includes any unauthorized use of copyrighted music, videos, images, or any other content not originally created by you. You will be solely liable for any damage resulting from any infringement. If a third party brings a claim against World of WOW related to your actions or content, you agree to indemnify, defend, and hold us harmless from all resulting liabilities or costs.
3.7 The Platform is provided to you “as is”. We do not guarantee that it will meet your expectations, be error-free, or be uninterrupted or secure.

Article 4 – Intellectual property

‍4.1 All intellectual property rights (including but not limited to copyrights, domain names, trademark rights, patents) pertaining to the Platform and all content provided in or through the Platform are vested in us and/or our licensors.
4.2 You must refrain from any act that infringes, obstructs, damages or endangers our or our licensors’ intellectual property rights.

Article 5 – License to use your personal account

‍By using the Platform, you grant World of WOW a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, modify, and display your personal account and any content on the Platform for promotional and marketing purposes, including social media and advertising.

Article 6 – Updates

‍We may release updates that include improvements, bug fixes, and patches. Ensure that your device installs these updates so that the latest version of the Platform is always in use. We are not obligated to support outdated versions.

Article 7 – Privacy

‍The use of the Platform is subject to our privacy policy.

Article 8 – Third-party information/websites

‍Some information in the Platform is provided by third parties. We are not responsible for such content. Use of third-party links and services is at your own risk.

Article 9 – Disclaimer and limitation of liability

‍9.1 The Platform is provided "as is". We are not liable for any direct or indirect damages.
9.2 Indirect damages include lost profits, data loss, reputational damage, and other consequential losses.
9.3 If our liability cannot be excluded, it is limited to €50 per calendar year.
9.4 This limitation does not apply in cases of deliberate misconduct by World of WOW.

Article 12 – Amendments

‍We reserve the right to amend these Terms. Updates will be announced via the Platform. Continued use means you accept the revised Terms.

Article 13 – Governing Law and Disputes

‍13.1 These Terms are governed by Dutch law.
13.2 Disputes will be submitted to the competent court if not resolved amicably.

Privacy Policy - World of WOW

Introduction

‍This World of WOW platform Privacy Policy (the Privacy Policy) is drafted by World of WOW Holding B.V., a company based in (5617 BC) Eindhoven at Torenallee 20, registered with the Dutch Chamber of Commerce under number 92209688 (hereinafter referred to as World of WOW, we, our or us).

This Privacy Policy is applicable to the processing of personal data of influencers (creator) and users (user) (together you or your or users) making use of the World of WOW platform (the Platform).

By means of this Privacy Policy we provide you with insight into the personal data we collect when you use the Platform, why we collect this personal data and what we do with this personal data. When processing personal data, we ensure that your personal data is handled and secured with the utmost care. In doing so, we comply in all cases with the applicable laws and regulations.

Please read this Privacy Policy carefully before using the Platform. By using the Platform, you agree to the contents of this Privacy Policy.

GDPR Applicable

‍This Privacy Policy is drafted in accordance with the norms of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

Grounds

‍If and insofar we process personal data in relation to your use of the Platform, this processing shall be based on one of the following GDPR grounds:

1. Your consent;
2. Performance of an agreement between you and World of WOW;
3. Our statutory duty;
4. Legitimate interest of World of WOW or a third party.

Legitimate interests include: advertising, marketing, security, auditing, fraud detection, (crime) prevention, (market) research and analysis, improvement of our products and services, internal management, legal affairs and business management.

Each specific processing activity is explained below.

Data Collected

‍Account creation

‍Influencers can create an account to use the Platform. Required information includes:
– First name, last name and email address
– Username
– Password

Display of content

‍Creators can upload content which may contain personal data (e.g. names, images, voices). Uploading content implies consent to its use under this Privacy Policy.

Use and status of the Platform

‍We collect usage data and operational status of the Platform to keep it functional.

‍We may use your contact details to send non-marketing messages related to your use of the Platform.

Testing, analysis and development

‍We analyze usage to improve functionality, detect errors, and develop the Platform further.

Data aggregation

‍To limit personal data use, we may aggregate or encrypt data into anonymous forms.

Legal compliance

‍We may process your data to comply with legal obligations, such as tax filings or court orders.

Fraud detection

‍We process personal data to detect or prevent fraud. If fraud is suspected or confirmed, your data may be used to prevent future access.

Retention Period of Personal Data

‍We will not retain your personal data longer than allowed by law or than is necessary. After account deletion or unsubscription, data may be kept for up to 12 months.

Note: Aggregated and anonymized data may be retained indefinitely for research, analysis and fraud prevention.

Provision of Personal Data to Third Parties

‍External service providers

‍We may share personal data with parties who assist in providing the Platform (e.g. hosting, analytics, email, IT, support, diagnostics).

Competent authorities

‍Your data may be shared with law enforcement or authorities if legally required.

Transfer

‍In the case of a company merger, sale, or reorganization, your data may be transferred. If required, we will seek your consent.

Where applicable, we enter into data processing agreements with such third parties, who will only act under our instruction.

Transfer of Personal Data Abroad

‍Except as described below, personal data is processed within the European Economic Area.

If data is transferred abroad, it will only go to countries with adequate protection or under appropriate safeguards (e.g. EU model clauses).

At the time of this Privacy Policy, data is transferred via Amazon Web Services EMEA SARL, based in Luxembourg, using EU-approved safeguards.

By using the Platform, you consent to such transfers where applicable.

Security

‍We implement security measures to protect your personal data from loss, unauthorized use, and alteration. These measures are regularly reviewed and updated.

Your Rights

‍You have the right to:

– Know what personal data we collect and what we do with it
– Access the personal data we hold about you
– Correct incorrect data
– Delete outdated or unnecessary data
– Withdraw your consent
– Object to specific data use

Complaints

‍If you have complaints, please contact us directly via the details below. You also have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Amendments

‍We may amend this Privacy Policy. We will not reduce your rights without your explicit consent. The latest version is always available on the Platform.
